TERMS AND CONDITIONS

Article 1. Purpose

These Terms and Conditions of Use(“Terms”) govern the rights and obligations of the Parties resulting from the sale of Product(s) (Products) offered on the website www.djakob.com (Site “, "DJAKOB", "Seller"). The Site is operated by DJAKOB*

 

Article 2. Contract parties

SELLER: DJAKOB

CUSTOMER: non-trader individuals who operate for purposes which exclude any professional or commercial activity.

 

Article 3. Acceptance of the terms and conditions

These Terms govern without restriction the sales of products made between DJAKOB and the Customers on the Site www.djakob.com .

You must be at least 18 years of age to use this Site. By using this Site and by agreeing to the terms and conditions herein, you warrant and represent that you are not less than 18 years of age. 

When you visit this Site or buy a product on it, you agree to be bound by the sales terms and conditions. DJAKOB does not accept any other terms and conditions unless we have agreed otherwise in writing.

We reserve the right to revise these Terms at any time by amending this page. Updated terms will supersede all previous versions of the Terms. Please check this page regularly to take notice of any changes we have made, as they are binding on you.  Those changes will go into effect on the “Last revised” date shown in the Terms. By continuing to access or use the Site, you agree to the revised Terms.

Please click on the final button marked “Complete Order” at the Order Confirmation section of the www.djakob.com before placing your order with us (“Order”) to show that you accept them. Please understand that if you refuse to accept these Terms, you will not be able to order any Product(s) from us.

Article 4. Documents

  1. The Customer may purchase any Product presented as available and at the price indicated on the Site at the time he places his order.

  2. Placing an Order constitutes the Customer acceptance of the prices and characteristics of the Products purchased on the Site, as well as of these Terms and Conditions. Our acceptance of your order brings into existence a legally binding contract between us. The Customers is entirely responsible to read and keep a copy of these conditions of sales.

 

Article 5. Registration on the Website and Customer personal data

  1. In order to place an order on the Site, each Customer must create a Customer account by following the registration procedure and by providing the necessary information.

  2. On the creation of his account, the Customer chooses a user ID and a password which will be specific to him to identify himself on the Site. He is solely responsible for keeping these elements confidential.

  3. Customer personal data will be protected in compliance with UE legislation, called “Right to the protection of personal data”.

  4. DJAKOB guarantees that the processing of personal data will be carried out in compliance with the fundamental rights above mentioned, with specific attention to privacy, personal identity and the right to personal data protection. All details communicated by the interested parties are utilized exclusively to fulfill commercial activities, such as the supply and sales of products and related services like carry out market research. Only after their authorization, Customers personal data may be used for the purpose of mailing advertising or direct marketing material.

  5. Use of Customer personal data for the purpose of mailing advertising or marketing related business is optional and decided by Customer at registration time or later.

  6. It’s the Customer’s exclusive responsability to:

  • ensure the accuracy of the personal data provided as required by the Site

  • rectify, modify and delete his personal data, in order for them to be always updated and valid

  • keep USER ID and PASSWORD confidential

 Seller is not responsible for wrong use of passwords

Article 6. Prices and products

  1. All metal parts of the jewelry are made of 925/1000 sterling silver.

  2. Colour of natural stones can change when using harsh soaps on the stones. Sterling silver jewelry oxidise when exposed to air/skin. Sterling silver jewelry can be cleaned with an appropriate silver cleaner (fluid not polishing paste) or a soft cloth. When a piece of jewelry  is gold plated, the gold can fade away after a certain time. This depends on the use, type of skin and treatment of the piece. This is normal wear and tear.

  3. The Product prices are indicated on the Site in Euros, US Dollars and British Pounds.

  4. The Seller reserves the right to modify prices. The Customer has to pay the full price agreed at payment time.

  5. The Seller reserves the right to revise pricing, products and other errors and to cancel any order you have placed if there was an error concerning the price or availability of any item you ordered when you placed the order, even if you have received an order confirmation. If your credit card has already been charged for the purchase and your order is cancelled, the Seller will issue a credit to your credit card account in the amount of the charge. Your bank or credit card company policies will determine when this amount is credited to your account.

  6. Please note that occasional pricing and other errors may occur on the Site.

  7. For delivery to European Union countries prices include taxes.

  8. Outside European Union all the Customs procedures and any possible adding costs (e.g. packages stopped by Customs) remain at the exclusive charge of the Customer.

  9. Promotions, promo codes, coupons are valid only if confirmed by the Seller in the order confirmation.

  10. DJAKOB has made every effort to display as accurately as possible the colors of the products that appear on www.djakob.com. However, as computer monitors vary, we cannot guarantee that your monitor’s display of any color will be completely accurate.

 

Article 7. Delivery of the order

Our products are sold subject to availability. When placing your order, ensure that the number, size and price of each item are mentioned correctly on your purchase order. When a product is no longer available, it will be marked „OUT OF STOCK”. In this case you can contact us in order to be the first informed when it becomes available again on the site.

After registration on the Website, Customer can place the order.

After placing the order, Customer should choose payment method and indicate billing and shipping address.

 

Article 8. Payment methods

  1. The Seller accepts only the payment methods indicated on the Site. Other methods can be accepted only with prior consent of the Seller (for further information send an email to info@djakob.com).

  2. In case of payment with credit card or PayPal, they are made via a secure platform. There is no way the Seller may know the credit card number. The payment made may not be cancelled.

  3. If you purchase any product on the Site, you will need to provide certain information relating to your purchase, including without limitation your credit or debit card number, the expiration date of your credit card, your billing address, and your shipping information. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT/DEBIT CARD(S) UTILIZED IN CONNECTION WITH ANY TRANSACTION. You also grant us or the third vendor collecting that information on our behalf the right to provide such information to third parties for processing the transactions initiated by you or on your behalf. We may also need to conduct certain verification of information prior to processing any transaction.

  4. Title to all products and risk of loss or damage is only transferred to the Customer upon shipment from DJAKOB. It is Customer responsibility to comply with all applicable laws in regard to the possession, use and sale of any item purchased from the Site. By placing an order, you represent that the products ordered will be used only in a lawful manner.

 

Article 9. Confirmation of the order 

  1. Following the payment, a confirmation email summarising the details of the Order is sent to the Customer, to the email address indicated at the transmission of his contact details. If, no later than 24 hours following acceptance of the payment, the Customer doesn’t inform the Seller about changes or modifications, the details and data provided will be accepted and the order actually registered and considered definitive.

  2. In the event of the unavailability of a Product, the Seller will inform the Customer as soon as possibile and no later than 30 days after validation of the order and payment.

  3. In the above mentioned case, the Seller will cancel the entire order and refund its amount to the Customer.

  4. Otherwise, with prior authorization from the Customer, the Seller could deliver a product of an equivalent quality and price.

  5. DJAKOB reserves the right not to validate the Order on legitimate grounds and in particular in the event of:  

–  abnormal or abusive claims from the Customer during his previous Orders;

–  abnormal or abusive exchanges and returns from the Customer during his previous Orders;

–  existing dispute(s) with the Customer;

–  no goods in stock for any reason. 

     6. The Seller will prepare the order in the next 2-4 business days from Monday to Friday from 9 a.m. to 3 pm – local time.

 

Article 10. Delivery of the order 

  1. While we attempt to ship all orders as soon as possible, most orders received  after 11 a.m. will likely go out the following business days. We do ask that you allow up to 2-4 business days for orders to be fulfilled.

  2. DJAKOB has chosen DHL as a transport partner for international orders.

  3. Products are delivered to the address indicated by the Customer when he places his order on the Site.

  4. The delivery slip handed over by the carrier will constitute proof in respect of transport and delivery.

  5. IN CASE OF DELAYS, DAMAGE, TOTAL OR PARTIAL LOSSES OF PRODUCTS AND/OR OF THE ORDER, IT IS THE RESPONSIBILITY OF THE CUSTOMER TO EXERCISE ANY REMEDY DIRECTLY WITH THE CARRIER AND TO INFORM DJAKOB AT THE SAME TIME.

  6. DJAKOB will make its best effort to ensure that the orders will be delivered in a period of time between 3 and 10 business days as of receipt of the Customer’s payment. In any event, all products purchased will be delivered within a maximum period of 30 working days from the day following receipt of payment of the order.

  7. Customized products will be delivered within 10-20 working days and in any event within 30 working days as of the day following receipt of payment of the order.

  8. DJAKOB may not be held responsible for delays in delivery due to errors attributable to carriers.

  9. DJAKOB may not remedy any defaults in execution of the carrier which it does not want to assume, but may possibly help the Customer with the carrier.

  10. Please note that, in the event of the absence of the recipient on delivery the products will be returned to DJAKOB, return transport costs and stock fees remaining at Customer’s charge.

  

Article 11. Reception of the order 

  1. The Customer must verify the condition of the parcel. He must check the condition of the package delivered before signing the acknowledgement of receipt.

  2. If the Customer finds any anomalies, he must refuse the delivery of the parcel.

  3. After 14 days, claims are not accepted and the products will be considered checked and verified by the Customer.

  4. DJAKOB jewelry is entirely handmade, that’s why every product is unique; little differences between what is received and pictures shown on the Website will not be considered as variation.

 

Article 12. Right of withdrawal and returns

Return and exchange policy

We believe in excellent customer service and that no purchase is final until you are completely satisfied. Any item can be returned within 14 days. This is from the day that the item was received. The item returned must be unused, unworn, unaltered and in the original condition, with tags attached and in its original packaging. The merchandise must not be altered. All goods will be inspected on return and any item in unsuitable condition will be sent back to you.

Please note that the items are your responsibility until they reach the workshop and please ensure you package to prevent any damage to the items or boxes. DJAKOB is not responsible for any items that are returned in error which is why it is recommended to use an ensured postal service.

Any costs connected to a returned item are your own. Once we receive your returned parcel, we will inspect and process the goods within 2 working days to ensure you receive your refund as quickly as possible. Any refund will automatically be issued to the card used to make the original purchase.

If you wish to exchange an item, please write an email with the specific details to info@djakob.com. Any exchange must take place within the 14 days of return right. Shipping cost of exchanged goods is your own. If accepted, the reimbursement will be made within 30 days as of receipt of the products returned to DJAKOB in the same way as the order was paid.

Additional Information

International Orders, meaning outside Europe, are responsible for overseas shipping costs, and for all incurred delivery fees, VAT taxes and import surcharges for all exchanges and refunds. Make sure to contact us before returning the product(s), we will support you in trying to prevent these fees.

Please note that custom made orders cannot be returned or exchanged.

 

Article 14. Exceptions 

  1. The right of withdrawal will not be accepted for products which are made specifically or customized for the Customer. If the Customer finds any lack of conformity or a hidden defect in the Products, he must immediately inform the Seller.

  2. Personalized or customized products cannot be reimbursed.

 

Article 15. Warranty and compliance and replacement of products 

  1. The Seller takes every care to ensure that the description and specifications of the products are correct at the time of purchase and delivery. The Customer benefits from the legal compliance warranties from the date of delivery (shown on the transport document).

  2. DJAKOB jewelry is protected under warranty for a period of 12 months from the original purchase date. The warranty covers materials and manufacturing defects. In case of defect, the components will be repaired or replaced at our discretion, free of charge. Please note that any evidence of tampering will void the warranty.

  3. If the Customer was to find any lack of conformity or a hidden defect in the products ordered, he must inform the Seller by email at info@djakob.com.

  4. After expiration of the Warranty, for repairs we will charge our Customers an adequate amount.
